A Rightful Heir to the estate bequeathed by the 39th Congress is the progeny of those emancipated by the Gradual Abolition Act of 1780 and the Emancipation Proclamation in 1863. Our goal is to finish the work of Reconstruction (Reconstruction 2.0) and moot further challenges to its intended purpose from the social, political, and economic landscape of America, as promised by the 39th Congress under the Thirteenth Amendment. As heirs to a vast estate muddled under decades of misappropriation and malfeasance, we assume the responsibility of expanding the Thirteenth Amendment to provide clear legal remedies for the ongoing badges, incidents, and vestiges of slavery that persist in our society. While crucial landmark cases like Jones v. Mayer Co. confirmed this power, the Supreme Court's interpretation of what constitutes badges and incidents of slavery remains rudimentary, making it difficult to address ongoing forms of systemic injustice faced by people of emancipated ancestry. This decision arbitrated to the nation's inferior courts that any characterization or attempt to define slavery’s modern badges & incidents would be construed as a usurpation of Congressional powers. While Jones revived the Badges, Incidents & Vestiges Doctrine, it left the question of the amendment's scope unanswered. In light of this reality, we are working tolobby Congress to convene a Standing Committee on the Thirteenth Amendment—one dedicated to establishing a framework for legal clarity and legislative action for a clear and unadulterated abolition of slavery’s insidious badges, incidents and vestiges. We believe our efforts will produce the needed results.
